How to Serve Legal Process in the U.S.

U.S. law enforcement and regulatory agencies

Mailchimp accepts service of legal process from federal, state and local law enforcement agencies, courts and regulatory agencies in the United States through its registered agent, Corporation Service Company (CSC). Legal process may be served in-person or by mail at the following address:

It is Mailchimp’s practice not to accept requests sent via email or mail to Mailchimp’s headquarters or any other Mailchimp office locations, unless expressly permitted by the laws, rules or regulations governing your legal request. Please note that service made by means other than CSC may not be handled efficiently.

Mailchimp reserves the right to object to any legal process it receives, including but not limited to overbroad and/or burdensome requests.

Civil Actions

Legal process for civil matters must be made pursuant to the rules applicable to the jurisdiction in which the matter is pending. Mailchimp will respond to subpoenas or other legal process properly domesticated and served in accordance with the federal and/or state procedural rules of the United States District Court for the Northern District of Georgia or the Superior Court of Fulton County, Georgia.

Legal Process from Outside the U.S.

Mailchimp is a U.S.-based entity and, in general, does not accept legal process from outside the United States. Mailchimp only responds to foreign government requests made through a Mutual Legal Assistance Treaty or another available diplomatic means to obtain information from Mailchimp.

If You Are Seeking Information from Mailchimp

In all instances, Mailchimp strives to maintain user privacy and confidentiality. As such, we will not respond to a valid request unless it includes adequate and specific information that enables us to locate and identify the correct account(s).

The most definitive identifying information that allows for the identification and location of a specific user account(s) is the email header associated with any email(s) sent from the account. Alternatively, it may be possible to identify and locate account(s) by the email address, internet domain, username, first and last name, business or company name, and/or IP address associated with the account(s).

Additionally, the Electronic Communications Privacy Act of 1986 (18 U.S.C. § 2510, et seq.), and in particular, the Stored Communications Act (18 U.S.C. §§ 2701-2712), may restrict the scope of information and records that Mailchimp can disclose, and any response by Mailchimp will be in accordance with these statutes.

Finally, please be advised that Mailchimp reserves the right to provide customers with notice of legal process seeking data or information from or related to their account(s) and, in certain instances, the terms of Mailchimp’s agreement with its customers obligates such notice (unless prohibited by law).

Response time

Response time is approximately 30 days, but will vary depending on the scope of the request and the type of information requested.
