The following payment terms for Monthly Plans (“Legacy Payment Terms”) apply to you and your account in lieu of Section 7 of the Standard Terms of Use. You and your account are subject to the remainder of the Standard Terms of Use for so long as you are a Member.
If you choose a new plan or purchase new Pay as You Go Credits any time on or after May 15, 2019, or if 90 or more days have passed since your last payment to Mailchimp, then these Legacy Payment Terms will no longer apply to you and your account, and you and your account will be subject to the entirety of the Standard Terms of Use for so long as you are a Member.

7. Monthly Plans
For your paid monthly plan (“Monthly Plan”), you agree to monthly recurring billing, starting on the date you signed up. Billing occurs on the same day each month, based on the date that you started your Monthly Plan. Billing for Monthly Plans may be paused, and you may choose to close your account permanently at any time.
Our charges for Monthly Plans are posted in your account (navigate to “Account,” then “Billing,” then “Monthly plans or credits”) and may be changed from time to time. If any part of a month is included in the Term, then payment is required for the full month. Payments are due for any month on the same or closest date to the day you made your first monthly payment (the “Pay Date”). If you go over your sending limit and reach another pricing level, then you’ll have to pay at the higher level on or before the next Pay Date. If the Term ends before that payment is due, you’ll still be required to make one payment at the higher level.
Your Monthly Plan pricing will be based on the number of email subscribed contacts in your account. You may elect to archive any of those subscribed contacts at any time, but any profile changes for an archived contact (whether initiated by you, the contact, or an integration) will automatically unarchive that contact. You cannot engage in any activity through the Service with archived contacts unless and until they are unarchived. If a subscribed contact is unarchived, it will immediately count for purposes of your Monthly Plan pricing for your current billing cycle and any future billing cycles unless and until archived again.
